Book Candy Studios (hereby referred to as "BCS") uses licensed, royalty free materials for the creation of the deliverable. Customer orders are subject to BCS production schedule and availability. Customer orders with multiple deliverables will be executed sequentially, not concurrently.

 

The BCS deliverable is created for the purpose of internet advertising and promotional use only. The deliverable cannot be redistributed, licensed, or sold, nor can the customer claim any copyright to any individual media elements (i.e., image, video, music) used in the deliverable composite. 

 

BCS will be held harmless against any claims of libel, copyright, or trademark infringement brought against customer with respect to the creation and use of said deliverable.

 

Should customer supply BCS with creative materials, customer affirms that they are the full copyright owner of the supplied materials or have obtained proper permission from the copyright owner(s) for use of said materials. Customer will indemnify BCS and hold BCS harmless against any claims of libel, copyright, or trademark infringement brought against BCS with respect to use of said supplied materials. 

 

BCS reserves the right to reject any creative materials or customer requests that may conflict with the company’s design approach, production process, and brand.

 

BCS will remain full owner of the license and intellectual property rights of the individual elements (i.e., stock footage, music, photos, etc.) embodied in the final deliverable.

 

BCS is not responsible for third party terms and conditions that may apply to digital distribution of the deliverable or advertising results.

 

BCS is a corporation and legally able to be engaged to do such work. The Terms & Conditions will be governed by the laws of the State of Georgia.
